| Wednesday | Class Collaboration on Bill of Rights Applying Bill of Rights to Amendments Read the following cases and determine which Amendment in the Bill of Rights is in question. Explain in a sentence what amendment is the issue and how it relates to the cases below. The 1st, 4th, 5th, 6th, and 8th Amendments are represented below. Two students wore black armbands to school in December 1965 to silently protest the Vietnam War. School officials said the expression would disrupt the school. A jury found Gregg guilty of armed robbery and murder and sentenced him to death. On appeal, the Georgia Supreme Court affirmed the death sentence except as to its imposition for the robbery conviction. Gregg challenged his remaining death sentence Defendant Bostick boarded a bus from Miami to Atlanta. At a stopover in Ft. Lauderdale, the bus was boarded by two uniformed narcotics officers who were performing a routine inspection of the bus. Without reasonable suspicion, the officers approached Bostick in his seat and requested to see his ticket and identification Gideon was charged in a Florida state court with a felony for breaking and entering. He lacked funds and was unable to hire a lawyer to prepare his defense. When he requested the court to appoint an attorney for him, the court refused, stating that it was only obligated to appoint counsel to indigent defendants in capital cases. Gideon defended himself in the trial; he was convicted by a jury and the court sentenced him to five years in a state prison. In 1963, Ernesto Miranda (born in Mesa, Arizona in 1941, and living in Phoenix, Arizona with only an elementary school education) was arrested for robbery, kidnapping and rape. He was interrogated by police and confessed. At trial, prosecutors offered only his confession as evidence. Miranda was convicted of rape and kidnapping and sentenced to 20 to 30 years on both charges The high school principal cut stories dealing with divorce and teen pregnancies from the school newspaper. |
